The Workplace Relations Commission found that Condi Hospitality Limited unfairly dismissed Barbara Mc Donagh and awarded her €6,000. In a decision dated 10 April 2025, it also upheld seven complaints concerning her employment after a business transfer, statutory notice and annual leave.
The WRC found that the transfer rules applied and that Mc Donagh’s service carried over. It said her dismissal appeared to follow no procedures or process. She told the hearing that she was dismissed with immediate effect after workplace disagreements, and that her termination letter described her as being on probation despite her earlier service. The company did not attend the remote hearing.
The Commission awarded €1,500 over her transferred job title and hours, and €740 each for failures to inform employee representatives, consult, advise her about the transfer and observe transferred terms. It awarded a further €740 under minimum notice law. The WRC also found 124 hours of annual leave were owed and awarded €2,300. The decision’s findings section gives €750 for the complaint about observing transferred terms, while its operative Decision gives €740; this account follows the operative Decision.
