WRC finds driver and employer mutually agreed to end employment

The Workplace Relations Commission found that a driver was not wrongfully dismissed after he declined alternative duties while his employer’s truck was off the road. The decision was dated 9 January 2024, and no recommendation was made. The worker said he was employed to drive and had no work while the truck was being repaired. The employer said it offered him painting work and kept his job open, but he refused duties other than driving. The adjudication officer accepted that alternative work had been offered and refused, and found that the decision to end the employment was mutual after the worker sought other work.
