The Workplace Relations Commission (WRC) found that Olivia Whelton’s annual leave complaint against Home And Away Care was not well founded. The decision, dated 30 April 2024, concerned her claim for annual leave for time spent on call. Whelton worked as a healthcare assistant and on-call coordinator, with an on-call schedule from 5pm to 8am, four days a week. The company said she received a €100 allowance for each on-call shift whether or not she was called, and standard pay for duties she performed. The adjudication officer said receiving an on-call allowance did not automatically create an annual leave entitlement. Whelton provided no details of hours worked during on-call periods, so the officer found no hours had been worked for the claim.
