The Workplace Relations Commission ordered Tanla Brook Ltd to pay Louise Smyth €2,160 for unfair dismissal and a separate €2,160 for failing to provide written terms of employment. The decision was dated 28 March 2024. Smyth’s complaint that she was owed redundancy entitlement was disallowed after both sides confirmed she had received it.

Smyth said she had not been told she was dismissed in September 2023 and that the company continued trading and hired someone to do her job. Tanla Brook Ltd rejected her complaints and said it had ceased trading on 29 September 2023. The adjudicator preferred Smyth’s account and found that the company had not followed procedures before dismissing her.

The unfair dismissal award was equivalent to four weeks’ pay. The adjudicator noted that Smyth had no financial loss arising from the dismissal. In a separate finding, the company had acknowledged that it did not give her written terms; the adjudicator found breaches of the law and ordered a further €2,160, also equivalent to four weeks’ pay. The redundancy complaint was disallowed because the entitlement had already been paid.
