The Workplace Relations Commission rejected Gerard Carey’s complaints of unfair dismissal and failure to provide minimum notice, finding the dismissal fair. Adjudication Officer Michael McEntee’s decision was dated 29 January 2025. Carey had been arrested over alleged thefts from airport retailers; the WRC noted he was not convicted in the ordinary courts.

Carey argued that the investigation and appeal were unfair and that the dismissal did not account for mitigating circumstances. DAA said its process was fair and that the alleged theft broke the trust required in his senior airside safety role. The officer found the process fair and the employer’s decision well considered. The minimum-notice complaint also failed because the dismissal was not found unfair.
