The Workplace Relations Commission found that West Wood Club Company Limited By Guarantee discriminated against Robert Flynn over shower facilities and victimised him by ending his membership. It ordered the gym to pay €5,000 for discrimination and €3,000 for victimisation, and to re-evaluate its shower facilities. The decision was dated 27 January 2025.
Flynn said the shower was unsuitable for his needs and that his membership was terminated after he raised the issue. The gym denied discrimination and said it ended his membership because of his conduct towards staff. The adjudication officer found the gym had not assessed whether the shower could reasonably be adapted and that Flynn was retaliated against for invoking his rights.
