The Workplace Relations Commission awarded Caitlin Kavanagh €896 after finding she was unfairly dismissed from her job at Peony Garden restaurant. The decision was dated 16 April 2024.

Kavanagh said she was dismissed by text after raising concerns about new duties involving chemicals and working at height, and about a lack of training. Goodfaith Catering Limited Peony Garden Prosperous denied dismissing her and said she had left by mutual agreement; it said it offered her another job and paid her a €300 golden handshake.

The adjudicator found the messages showed that Kavanagh had been dismissed. He said it was unreasonable to dismiss her in the circumstances and found the employer had used no procedures before doing so. The Commission awarded her eight weeks’ pay, equivalent to €896.
