The Workplace Relations Commission directed Galgorm Group to pay Brendan Bannigan €1,410 in compensation after finding he was owed annual leave and public holiday pay. The decision was dated 15 April 2024.
Bannigan, who worked as a driver, disputed the employer’s calculations of his holiday entitlement. The employer accepted shortfalls in its annual leave calculations and apologised for a lack of clarity. The adjudicator found shortfalls of 7.25 hours for 2021, 36 hours for 2022 and 18 hours for 2023, as well as 36 hours’ pay for four public holidays.
The Commission found Bannigan had an outstanding entitlement to 97.25 hours’ pay when his employment ended. It calculated the compensation using his final hourly rate of €14.50. The adjudicator had extended the time limit for the public holiday claim to 12 months because Bannigan had experienced difficulties getting clarity from the employer.
