WRC awards takeaway worker €1,328 for annual leave

The Workplace Relations Commission awarded Abbigail Ivors €1,328 for unpaid annual leave in a decision dated 22 March 2024. It also awarded her €828 for constructive dismissal, €345 for public holiday pay and €207 for not receiving written employment terms. Ivors worked for Nico Arra Takeaway Ltd and said she had no written contract or holiday pay. The WRC found that the employer had not provided written terms and upheld her constructive dismissal complaint after she left following a dispute about holiday pay. The employer did not follow up to check whether she had resigned in the heat of the moment. The officer found three other complaints were not well founded, and one was a duplicate of the successful public holiday claim. Five complaints, including claims under industrial relations and mobile working time rules, were withdrawn.
