The Workplace Relations Commission found three complaints by Henryk Miszka against Tesco Ireland Limited not well founded. The decision, dated 23 April 2024, concerned annual leave and statutory sick leave. Miszka said he had not received all annual leave due when his employment ended after a long illness. Tesco disputed a shortfall and said it had overpaid him. The officer found Tesco had met its annual leave obligations; the final payslip recorded €4,559 gross in unpaid holiday pay and the officer considered the company may have overpaid. The officer also found Tesco’s sick-pay scheme was more favourable overall than the statutory scheme.
