The Workplace Relations Commission found Stephen Walsh was not unfairly dismissed when his employment with Marymount University Hospital and Hospice ended after he reached the organisation’s retirement age of 65. The decision was dated 25 March 2024. Walsh, a healthcare assistant, argued that he should have been offered a fixed-term contract. The hospital said his employment ended at the normal retirement age and that a medical assessment found him unable to perform his duties. The adjudication officer found the retirement age was established and contractually recognised.
