The Workplace Relations Commission dismissed Karl Fallon’s disability discrimination, harassment and victimisation complaints against Tesco Extra Drogheda, finding that a supervisor helped him take a workplace COVID test at his request. Adjudication Officer Brian Dalton’s decision was dated 24 April 2025. Fallon alleged he was forced to take the test. Tesco said he was not forced and that the supervisor helped at his request. The WRC found he was not treated less favourably than a colleague without a disability, and found no harassment or victimisation. A related complaint about fair procedures in a disciplinary process was dismissed as out of time.
