The Workplace Relations Commission found Dublin Bus correctly calculated annual leave pay for driver Dermot Flanagan, rejecting his complaint under the Organisation of Working Time Act. The decision, dated 15 November 2023, concerned leave taken after Flanagan moved to a lower-paid 30-hour role inspecting buses for defects. Flanagan had sought the bus-driver rate for leave accrued while he drove but taken after he changed roles. Dublin Bus said it paid him at his normal weekly rate under his current contract. The adjudication officer found the law calculates normal weekly pay using the employee’s normal working hours last worked before leave. The complaint was declared not well founded.
