WRC had no jurisdiction over horticultural operative’s pay complaint

A Horticultural Operative’s pay complaint against Mushroom Production Company ended on jurisdiction grounds in a Workplace Relations Commission decision dated 30 January 2024. The worker alleged that piece-rate pay, long hours and weekend and overtime arrangements did not meet her permit terms or minimum pay requirements. The company denied the allegations and said mushroom harvesting was not covered by the Early Years employment order. The adjudication officer found there was no employment order for the mushroom industry. She also found she had no jurisdiction over the minimum-wage issue because the worker had not requested a written statement of her average hourly rate of pay; the merits were not decided.
