The Workplace Relations Commission awarded Fergal Mc Grath €18,000 compensation after finding he was unfairly dismissed by Kashan Carpets trading as Lynfrae trading Company Limited. The decision was dated 18 January 2024.
Mc Grath worked as a national sales representative. The company cited damage to a van, personal use of a company card and poor performance, while he said the concerns had not been raised with him before his dismissal.
The adjudication officer found the disciplinary process fundamentally unfair: Mc Grath had not been told the allegations or evidence in advance, the person who decided to dismiss him had also made the charges, no written confirmation or appeal was provided, and the meeting was not recorded. The parties preferred compensation, and the officer said reinstatement or re-engagement was inappropriate.
