The Workplace Relations Commission found a complaint against a crèche over a child’s exclusion from a class excursion was not well founded because it was brought outside the time limit. The merits of the disability allegation were not decided.
The parent brought the complaint on the child’s behalf under the Equal Status Act. The referral was received on 28 April 2023, almost a year after the most recent alleged incident on 7 May 2022. The adjudication officer refused an extension, noting that no reason was given for the delay after the parent sought legal advice in mid-January 2023. The decision was dated 13 March 2024.
