The Workplace Relations Commission found that Amber Springs Hotel Limited did not unfairly dismiss night porter Krystian Nawarski, whose employment ended after €150 went missing from a safe. The decision was dated 16 September 2024.

The hotel said CCTV showed Nawarski accessing the safe and treated the missing money as gross misconduct. Nawarski denied taking it and said he had gone to the safe to collect keys and a float as part of his job.

The hotel accepted that its first investigation and disciplinary meetings were flawed, then ran a second process. The adjudication officer found the dismissal fell within the range of reasonable responses and that the second process was comprehensive and fair overall, despite some faults. In plain terms, the officer considered the employer’s decision reasonable and its overall procedure fair.
