The Workplace Relations Commission found that Aryzta Bakeries Ireland Unlimited Company breached public holiday pay rules after Pawel Pisarek was not paid for three holidays while on certified sick leave. The decision, dated 12 August 2024, directed the company to pay him €400 compensation. The company had already paid about €900 for the holidays before the decision. Pisarek said the payment took nine months and sought more compensation than the company’s €400 goodwill offer. The company accepted there had been a delay, attributed it to administrative oversight, and said the offer remained open. The adjudication officer said the breach was unintentional and arose amid changes in human resources staff and supervision. The Organisation of Working Time Act requires employers to provide the relevant public holiday entitlement; the officer found the company had failed to pay an additional day’s pay for each holiday when due.
