Aldi Stores Limited (Ireland) unfairly dismissed Muhammad Kashif and must pay him €5,000, the Workplace Relations Commission has found. The WRC decision was dated 3 September 2024.
Kashif worked as a store assistant for Aldi. The company dismissed him after he was convicted of an offence committed at a separate workplace. Aldi argued the conviction created a risk in its mixed-gender workforce and justified dismissal. Kashif said the offence happened outside work and that he had told his manager about the conviction.
The adjudication officer found Aldi acted outside the range of reasonableness by failing to properly address Kashif’s disclosure and his uneventful service after it. The officer also found the earlier allegation that Kashif had failed to disclose the conviction was not upheld. Kashif contributed 50% to his dismissal and fell short of the expected steps to limit his losses. The €5,000 compensation was described as two months’ gross salary.
