The Workplace Relations Commission found that Elaine Maddock’s unfair dismissal complaint against the Health Products Regulatory Authority was not well founded. The decision was dated 19 August 2024.
Maddock, an Accounts Assistant who joined the HPRA in 2016, said she felt isolated and unsupported during performance improvement plans. The HPRA said it had tried to help her improve and had documented concerns about her performance over several years.
The adjudicator found that the HPRA had recorded persistent performance problems and had used a fair process overall. He concluded that the dismissal for capability or competence reasons fell within the range of decisions a reasonable employer could make. No award was recorded.
