The Workplace Relations Commission found that John Nsubuga was not constructively dismissed by Globoforce Ireland Limited T/A Workhuman after he resigned following a move to a technical team. The decision was dated 20 October 2023. Nsubuga said he had wanted to work in customer success and felt he had no choice but to resign when he was told he would move permanently to the technical team. The company said it offered training and support and that he resigned voluntarily. The adjudication officer found that the move was not a fundamental breach of his employment contract and that the company offered support. The officer also noted that Nsubuga had not used the grievance procedure. The complaint under the Unfair Dismissals Act was found not well-founded.
