The Workplace Relations Commission awarded Robyn Poole €5,000 after finding Cavan Monaghan Hospital Group Cavan General Hospital discriminated against her on disability grounds and failed to provide reasonable accommodation. The WRC decision was dated 28 February 2025.

The adjudication officer found the hospital failed to arrange an occupational health review before Poole’s emergency department rotation and discriminated against her in sick pay. Her separate Sick Leave Act complaint was dismissed as not well founded because the hospital’s contractual sick pay scheme was more favourable than the statutory entitlement.

Poole had alleged she was underpaid sick leave and that her treatment, including the lack of an occupational health review, amounted to disability discrimination. The respondent said outstanding sick leave had been paid and sought to withdraw both complaints; it provided no evidence responding to the equality complaint.
