Amir Sajad Esmaeily was awarded €53,000 compensation after Dublin Business School conceded that it had unfairly dismissed him. The Workplace Relations Commission decision, dated 14 October 2024, said the award covered financial loss, including estimated future loss of income.
The college dismissed Esmaeily in February 2023 after a disciplinary process over his access to college systems while abroad. He argued that his conduct was not gross misconduct and that the college had failed to consider another sanction. The college said the access breached its policy.
The adjudicator said Esmaeily’s job-search efforts did not meet the statutory requirements for limiting financial loss, but also considered personal events and the effects of the dismissal. Compensation is money paid to address losses caused by an unfair dismissal.
