The Workplace Relations Commission found that Sodexo Ireland Limited unfairly dismissed Nkemka Patrick Okachi and ordered his reinstatement on his previous terms and conditions. The decision, dated 27 January 2025, concerned the fairness of the investigation and dismissal after a client complaint alleging sexual harassment; it did not determine whether the alleged harassment occurred.

The adjudication officer found that Sodexo failed to follow fair procedures or its own policies, citing reliance on hearsay about CCTV investigators had not reviewed, failure to provide the original complaint, and a lack of objectivity and independence. Sodexo said the client complaint and Okachi’s conduct warranted dismissal. The officer found dismissal disproportionate given the evidence and noted there was no evidence of previous disciplinary sanctions.
