WRC finds Ewa Arcimowicz was not unfairly dismissed

The Workplace Relations Commission found that Ewa Arcimowicz was not unfairly dismissed, ruling that no dismissal had taken place. The decision, dated 30 November 2023, concerned her complaint against Equinox Management Ltd. Arcimowicz said a notification from the Revenue Commissioners led her to believe she had been dismissed. She said she continued working at the same premises and receiving weekly wages. The company said she remained employed and paid until she went on sick leave in September 2023. The adjudicator accepted evidence that her employment and wages continued, and said a mix-up after the company engaged new accountants meant the Revenue letter did not reflect the employment relationship.
