The Workplace Relations Commission ordered Temperature Ltd to pay Aoife McGarry €10,000 after finding that her dismissal was discriminatory. The decision, dated 23 May 2024, concerned McGarry’s complaint under the Employment Equality Act.
McGarry joined the company in September 2022 and was dismissed in March 2023 after failing to submit a medical certificate while on sick leave. The company said it did not know she had a disability and dismissed her for failing to follow its sick-certification policy. The adjudication officer found the company had constructive knowledge of a condition affecting her thought processes, emotions or judgement. He said her breakdown and absence were likely symptoms of disability, and that the company changed course from extending her probation to dismissing her after those events. The WRC found the complaint well founded and ordered compensation for the effects of discrimination.
