WRC found it had no jurisdiction over protected disclosures complaint

The Workplace Relations Commission found it had no jurisdiction over Noel Casserly’s protected disclosures complaint against Green Skibbereen CLG, saying he was not a worker under the law that applied at the time. The decision was dated 22 August 2023. Casserly said he raised concerns about the company’s governance and finances, was removed from its board and received an eviction letter. The company denied penalisation and said he was removed after making unauthorised withdrawals to pay creditors. The officer found the relevant law did not cover board members at the time of the alleged events and that the property sub-licence did not create an employment relationship. The merits were not decided.
