The Workplace Relations Commission found Marian Nowak’s complaint against Moorechall Disability Service T/A Mooechall Living not well founded in a decision dated 10 January 2025. No award was recorded.
Nowak alleged that the service penalised him in 2023 for protected disclosures made while he worked there as a care assistant. The service denied that he had made protected disclosures and said he had improperly obtained confidential information about residents.
The WRC decided the preliminary question of whether Nowak had made a protected disclosure. The adjudication officer found he had not established one under the Act, so the penalisation allegations were not determined on their substantive merits.
