The Workplace Relations Commission ordered Packlett Ltd Arlington Hotel to pay Colm O Donohoe €3,000 after finding it gave insufficient notice before requiring him to use outstanding annual leave during his notice period. The decision was dated 13 October 2023. O Donohoe had 15 days of annual leave outstanding when he resigned. The employer relied on a handbook provision allowing it to request accrued holidays during a notice period. The officer found the complaint well founded under the Organisation of Working Time Act 1997.
