The Workplace Relations Commission awarded Muhamed Delic €4,590 for financial loss after finding that Motorzone Detailing Ltd unfairly dismissed him by text message without giving him a chance to answer the allegations against him. The decision was dated 14 December 2023.

Delic said the dismissal followed an allegation of gross misconduct and claimed unpaid overtime, annual leave and a back week. The company’s representative, who joined as a director after the dismissal, could not give evidence about how it happened. The adjudicator found the employer had offered no evidence to justify the dismissal. In assessing compensation, the adjudicator considered that Delic had not applied for other work.

The WRC also ordered €538 for holiday pay and €500 for overtime and a back week. It found an Industrial Relations Act complaint not well founded, while Delic withdrew his redundancy complaint at the hearing.
