The Workplace Relations Commission ordered Bidvest Noonan (Roi) Limited to pay Lasma Megne €561.69 gross in annual leave pay, while dismissing her unfair dismissal and redundancy complaints. Adjudication Officer Louise Boyle issued the decision, dated 19 September 2024.
Megne resigned after being placed on lay-off while the company sought alternative work following the closure of her temporary work site. She said her treatment and delays in the disciplinary process left her no choice but to resign. The company said it had offered other roles and that she resigned before its redeployment process was complete.
The officer found the company had not breached Megne’s contract or acted so unreasonably that she could fairly resign and claim constructive dismissal. The lay-off lasted two weeks, so she did not meet the legal conditions for redundancy pay. The company accepted that €561.69 in annual leave pay was owed, and the officer ordered it paid.
