WRC finds supermarket did not discriminate in sales assistant’s dismissal

The Workplace Relations Commission found that a supermarket did not discriminate against a sales assistant by dismissing her after considering adjustments for her fish allergy. Adjudication officer Shay Henry dated the decision 25 March 2024.

The worker sought a move away from the shop floor, including a swap into an administrative role. The supermarket said it had obtained medical advice, offered work in the clothing department and had no administrative vacancy. The officer found that administration and cash-office work would have involved different roles, with no vacancies available, and that adjustments to the clothing department met the reasonable-accommodation requirements. The complaint of discriminatory dismissal was not well founded.
