The Workplace Relations Commission found Bogdan Krynicki’s holiday-pay complaint against Kepak Group not well founded in a decision dated 18 December 2023. Krynicki, who worked as a trimmer before resigning in September 2022, sought holiday pay for 2020 and 2021 and a pro-rata amount for 2022, saying he had been on sick leave. Kepak contested the claim. The adjudicator limited consideration to alleged breaches between 12 June and 30 September 2022, refused an extension of time and found that the doctor who issued Krynicki’s Polish medical certificates was not registered with the Irish Medical Council, as required for the statutory sick-leave provision he relied on.
