The Workplace Relations Commission found that Embecta did not discriminate against Laurence Mooney on disability grounds or fail to provide reasonable accommodation. Adjudication Officer Marie Flynn’s decision was dated 3 January 2024. Mooney said Embecta prevented him from returning to work despite medical advice that he was fit and did not make reasonable adjustments. Embecta said its occupational health assessments found he was unfit for his former role and that it was still assessing his return when he brought the complaint. Flynn found that the medical letters supporting Mooney’s fitness to return were qualified and called for further assessment. She also found that Embecta was still assessing his return when the complaint was referred. Both claims failed.
