The Workplace Relations Commission found Stephen Keogh’s complaint against Lynam Auctioneers and Estate Agents was not well founded, concluding that a delay in confirming the tenancy, rather than his HAP status, was decisive.
Keogh said he had been accepted to rent a property but that the tenancy fell through after he told the agent he received the Housing Assistance Payment. The agency said its offer required rent and a deposit within 24 hours, and that it did not hear from him or receive payment promptly.
The adjudicator found the offer had not been confirmed and the deposit had not been paid for eight days. The decision noted that the property was later let to another HAP tenant. The WRC decision was dated 4 August 2023.
