The Workplace Relations Commission found Mary Sweeney’s equal-pay complaint against The Galway Clinic not well founded, ruling that CT and MRI radiographers did not perform like work under the statutory test. The decision was dated 10 November 2023.
Sweeney, a Senior Radiographer, said she was assigned to CT work because of her disability and argued that the pay difference amounted to indirect discrimination. Until January 2023, MRI radiographers earned €2,250 more than CT radiographers.
The clinic said MRI work involved fuller patient lists, longer shifts and a more demanding schedule. The adjudicator accepted that Sweeney had been assigned to CT work because of her disability, but found the roles were not interchangeable and their differences were significant. The statutory equal-pay test requires workers to perform like work; the WRC was not satisfied that CT and MRI radiographers met that test.
