A WRC adjudication officer upheld four of six working-time complaints brought by chauffeur Adrian Taranu against the Embassy Of India, Dublin, and awarded him €750 for an annual-leave breach. The decision was dated 29 May 2024.
The officer also awarded €300 over public holidays and €250 for a weekly-rest breach, and directed the Embassy to ensure Taranu received statutory daily rest breaks. The annual-leave calculation did not comply with the law, and granting Indian public holidays breached his statutory entitlement.
Two complaints were not well founded: Taranu provided no particulars of missed breaks or excessive hours. The Embassy did not attend the hearing. In a letter, it disputed the complaints, said Taranu had received his contractual entitlements and claimed state immunity. The officer found his chauffeur duties did not involve exercising public powers, so state immunity did not apply.
