The Health Service Executive (HSE) has won an unfair dismissal case brought by senior occupational therapist Debaprasad Haldar, the Workplace Relations Commission (WRC) ruled in a decision dated 10 May 2024.
Haldar, who had worked for the HSE since 2006, argued that he was not allowed to comment on a report used in the decision to dismiss him and that fresh disciplinary proceedings should have been started. The HSE said it had provided support but that his performance remained below the required standard.
An earlier dismissal had been overturned on appeal, and Haldar was reinstated subject to probation and conditions. The WRC found that he had not been given a chance to comment on the later report, but concluded that this did not make the dismissal unfair in the circumstances. It found that the HSE acted reasonably and ruled that Haldar was not unfairly dismissed.
