Constructive dismissal claim against Pettits Supervalue fails after complainant misses hearing

The WRC found Veronica Kennedy’s constructive dismissal claim against Pettits Supervalue failed after she did not attend a hearing. The decision, dated 8 May 2023, said Kennedy had not established that the employer’s conduct entitled her to end her employment. Kennedy told a WRC case officer that she had mistaken the hearing date and would not attend. She did not apply for a postponement, although she was invited to do so, and the adjudication officer was satisfied she had been notified of the hearing. The respondent was represented and three witnesses attended. The complaint under the Unfair Dismissals Act was found not well founded after Kennedy did not attend; the merits were not decided.
