The Workplace Relations Commission found that Marcel Houssou’s race discrimination and victimisation complaints against Trinity Care Group, Saint Peters Nursing Home, were brought outside the time limit and were not well founded; the merits were not decided. The WRC decision was dated 19 April 2023.
Houssou said he experienced racial discrimination throughout his employment. The employer denied discrimination and argued that the complaints were late. His employment ended on 24 February 2021, and he submitted the complaints in September and October 2022.
The WRC found the complaints were outside the usual six-month period and beyond the possible 12-month extension. It therefore did not consider whether discrimination or victimisation had occurred.
