WRC says Traveller community member’s council complaint was out of time

By Niamh Kearney

Historic decision · Decision date:

Place: no local area assigned from the source.

The WRC found that a Traveller community member’s Equal Status complaint against a county council was brought outside the time limit and was not well founded; the merits were not decided. The decision was dated 20 October 2022.

The complaint alleged discrimination and harassment over a failure to provide basic sanitary and other services while the complainant’s family awaited permanent accommodation. The WRC found the latest possible date of the alleged conduct was 23 December 2016, but the complaint was received on 16 August 2017. It found no reasonable cause to extend the time limit. The adjudicator also substituted the county council for the individual employee named in the original complaint, finding the council was the proper respondent for conduct in the course of employment.
