The Workplace Relations Commission ordered J & J Retail Limited Trading as Jack & Jones to pay Jake Quinn €10,725 after finding it failed to pay Sunday premiums. The WRC also required the company to pay Sunday premiums to all its employees. Its decision, dated 6 April 2023, found Quinn’s separate complaint about public-holiday entitlements not well founded.
Quinn worked for the company from March to July 2022. He said he received no extra pay for Sunday work. The company confirmed it paid no Sunday premiums and that his contract did not address them. The WRC found his Sunday-premium complaint well founded and awarded compensation equivalent to six months’ remuneration.
On the public-holiday complaint, Quinn said he had not been paid for two holidays and had received partial payment for two others. He accepted that he had received 33.78 hours in holiday pay, including some public-holiday pay. The adjudicator was not satisfied he had shown he was unpaid for public holidays and found that complaint not well founded.
