The Workplace Relations Commission found Anne Kelly’s disability discrimination complaint against Bord na Mona not well founded, concluding she had not established a prima facie case. The decision was dated 2 February 2023. Kelly said she sought reasonable accommodation for interviews because of a medical condition and felt targeted by the employer’s response. Bord na Mona said it referred her for an occupational assessment after she disclosed her condition and provided the recommended interview accommodations. The complaint alleged a failure to provide reasonable accommodation and victimisation under the Employment Equality Acts. The officer found Kelly had not established a prima facie case on either allegation. She identified an incident in August 2021, which the officer said occurred after the incident giving rise to the complaint, and could not identify another alleged breach. The WRC did not uphold the complaint.
