The Workplace Relations Commission found Stephen Darling’s complaint that he was passed over for promotion because of his union membership and activity was not well founded. The decision was dated 3 July 2025. Darling, a Network Technician at Esb Networks, brought the complaint under section 9 of the Industrial Relations (Miscellaneous Provisions) Act 2004, alleging victimisation linked to his work for the Independent Workers’ Union. Esb Networks denied the allegation and said promotion decisions followed the assessment and selection process. No award was recorded. The adjudication officer cited the employer’s arrangements with recognised unions in finding the complaint, as presented, not well founded.
