The Workplace Relations Commission found two complaints by Transdev Dublin Light Rail Ltd employee Matthew Cullen were not well founded. The decision was dated 9 January 2024. Cullen’s separate Employment Equality Act complaint was withdrawn.

Cullen said his complaint about alleged racist remarks and discriminatory recruitment practices was a protected disclosure, and that he was penalised for raising it. The adjudication officer found he had made a protected disclosure but was not penalised because of it. The officer also found Cullen was not penalised after raising a safety concern about working with a Security Officer rather than another Authorised Officer.

The officer found Cullen left work of his own volition after refusing to perform revenue protection duties, and that a final written warning followed that refusal rather than his safety complaint. The WRC excluded covert recordings and transcripts, citing employees’ data rights and fair procedures.
