The Workplace Relations Commission found Elizabeth Quinn’s dismissal by Tesco Ireland Tesco fair and rejected her claim for notice pay. The decision was dated 14 February 2024.
Quinn had worked as a general assistant since 2006 and was dismissed after a disciplinary process. She said she was denied a fair chance to question witnesses and claimed eight weeks’ notice pay. Tesco said the dismissal followed serious misconduct, including customer treatment, while a final written warning for similar behaviour was still active.
The adjudicator preferred Tesco’s evidence, finding the conduct amounted to serious or gross misconduct and that dismissal was within the range of reasonable responses. In plain terms, the decision found that a reasonable employer could have dismissed her in the circumstances. It also found that no notice payment was due because she was dismissed for serious or gross misconduct. Both complaints were found not well founded.
