The Workplace Relations Commission found Joseph Madigan was not an employee of Callan Golf Club and could not pursue his unfair dismissal or minimum wage complaints. The decision was dated 2 February 2024. Madigan said the club ended his administrative work in November 2021 and that he had not received the minimum wage for his work. The club disputed that he was an employee and said he lacked the service needed to bring an unfair dismissal complaint. The adjudicator found that the evidence did not establish an employment relationship, noting the limited employment documentation and that payments were made without tax deducted at source. He also found Madigan had not completed one year of continuous service. The WRC therefore had no jurisdiction to hear the unfair dismissal complaint, and Madigan lacked standing to pursue the minimum wage complaint. The merits were not decided. No monetary award was made.
