The WRC recommended €10,000 compensation for a worker after finding flaws in a recruitment shortlisting exercise and an unacceptably long delay in an internal review. The recommendation was dated 7 December 2022.
The worker challenged the assessment for a driving role, saying driving aptitude and fitness were marked without practical tests. The employer said candidates were assessed consistently using their application forms and that changes to the essential criteria were necessary. The Commission for Public Service Appointments found the general scoring had been fairly applied, but identified problems with the driving and fitness assessment and the timeliness of the review.
The WRC adjudication officer questioned how the worker’s driving and fitness marks could be reached without practical assessments. The internal review report was issued in August 2021, and the officer found the delay unacceptable. The employer argued that the WRC lacked jurisdiction because the dispute affected a wider group, but the officer treated it as an individual dispute. The WRC recommended €5,000 for the shortlisting flaws and €5,000 for the delay.
