The Workplace Relations Commission awarded Marta Siudak €17,500 after finding that Slane Trading Company Limited discriminatorily dismissed her on gender grounds related to her pregnancy. The decision was dated 4 January 2023.
Siudak told the company she was pregnant in December 2021 and sought a risk assessment over workplace safety concerns. Remote working with revised duties and lower hourly pay followed, but the officer found no gender discrimination in those arrangements. The company cited operational problems and underperformance as reasons for dismissal; the officer found no contemporaneous records of performance concerns before the dismissal and said the company had not sufficiently supported its reasons.
Siudak withdrew her unfair dismissal complaint at the start of the hearing. Her separate discrimination complaints about remote working and the temporary pay reduction were not well founded; the complaint about discriminatory dismissal was well founded.
