The Workplace Relations Commission awarded teacher Martha McLoughlin €28,000 after finding she was unfairly dismissed on procedural grounds. The decision, dated 19 January 2024, said serious flaws in the school’s process denied her due process and affected the dismissal decision.
Kildare Town Community School said it dismissed McLoughlin over conduct concerns while she was on a final written warning. The adjudication officer found the concerns had not been adequately investigated and documented, and that an issue not raised with her was considered in deciding the sanction.
The officer found McLoughlin contributed to her dismissal by not cooperating or making representations under the procedures, reducing the estimated financial loss by 50%. The award was reduced further because of insufficient efforts to find work, leaving compensation of €28,000.
